I don't agree with this verdict. Musk said that he obtained funding to take Tesla private. He didn't. It wasn't a mistake; he had no confirmation that the funding was there. The defense said just because it was a bad tweet, that doesn't make it fraud. Why wouldn't shareholders believe him? He is the CEO and Tesla is a multibillion-dollar corporation. Of course the shareholders are going to believe him. They have zero reason not to. Consequently, shareholders suffered billions in damages. And Musk's response is, well sometimes the market is crazy. No apology. No acknowledgement of what his actions caused. Nothing.

Unbelievable.
Tesla's Elon Musk has been cleared of wrongdoing for a tweet in which he said he had "funding secured" to take the electric carmaker back into private ownership.
Shareholders argued he misled them with his posts in August 2018, and they had lost billions of dollars because of them. The proposed $72bn (£60bn) buyout never materialised. If found liable, Musk could have been ordered to pay out billions in damages. It took the nine jurors less than two hours to reach their verdict on the class-action lawsuit on Friday afternoon.Mr Musk - who had wanted the trial moved to Texas, where Tesla is based, arguing he could not get a fair trial in San Francisco - welcomed the outcome.Taking to Twitter, the social media platform he bought for $44bn last October, he posted: "Thank goodness, the wisdom of the people has prevailed!"I am deeply appreciative of the jury's unanimous finding of innocence in the Tesla 420 take-private case." Nicholas Porritt, a lawyer for the Tesla shareholders, said: "Our society is based on rules. We need rules to save us from anarchy. Rules should apply to Elon Musk like everyone else."Mr Musk's attorney, Alex Spiro, said: "Just because it's a bad tweet doesn't make it a fraud."After the verdict, Mr Porritt said: "We are disappointed with the verdict and are considering next steps."Mr Musk was generally calm during his testimony - though at times he appeared annoyed at the line of questioning.

From what I read, the tweet wasn't viewed as an official statement from Tesla, therefore it was basically considered "casual conversation" so to speak.

It would be kinda like Musk making the statement at a cocktail party instead of making an official press release about the future of the company.

That was just the way it was framed in the op-ed I read a week or so ago.

They should've tried him in a DC court. They definitely would've gotten a guilty verdict.

A DC jury would convict a ham sandwich for the Abe Lincoln assassination if it was made by a patriot who values the Constitution.

Yes, but it caused damages of literally billions of dollars. It was no small thing. Official or not, he said it for the shareholders to read with conviction.

I'm not saying it's right or wrong either way as I never have seen the context of the tweet itself... and honestly, I haven't really dug into the nuts and bolts of the case period.

I didn't even know it was a thing until you made a thread about it a few weeks ago.

I usually pay attention to things like this because I am always amazed of how the elite in our country are so blatantly above the law.

He's human, in theory. Or not, in theory. I have competing theories about most things.

If theory one is correct, then he is subject to emotion - not just reason. A reasoning person might foresee the results of the tweet and have a bad motive for making the tweet. An emotional person might be overly exuberant and unreasoningly certain of his funding.

It's like when a hot chick looks interested, and you convince yourself it means she's going to sleep with you. Perhaps elon convinced himself the funding was a sure thing. I can't judge - I wasn't on the jury.

How can you say he was above the law? He was dragged into court and made to face a jury, was he not?

Every accused person has the presumption of innocence. It's on the prosecutor to overcome that presumption. The prosecutor failed.

It was a tweet, it is well known that Musk is a twitter troll and not exactly stable... if shareholders base their decisions on his tweets they deserve to lose billions... it would be something different if it was announced on a shareholders meeting but sueing people for posting misinformation on twitter... lol... remember this one?

Not even close to being the same. This wasn't a gamble by the shareholders. Musk told them something deceiving. The shareholders made a decision based on the info given from the CEO of the company himself. There is a difference between saying that "such and such is possible that"...vs such and such has already happened." He tweeted "funding secured." Thereby, implying it alrady happened. That 9is not a gamble by the shareholders.

Again, like I said. He tweeted that funding was secured. That implies that it already happened.

Well, the jury felt like it was.

I suspect elon is posing as human and is actually a demon-child. So it's not like I have some loyalty to a billionaire. But I'm content to let juries sort this kind of ****. If elon pulled a **** and got away with it, se la vie.

And he was dragged in front of a jury, and he took the stand, and in spite of his autism, the jury liked him better than it liked the prosecutor. And they gave him a pass.

Get ice cream, bro.
