The Allegation
Almost thirty years ago, the future 45th President raped E. Jean Carroll at the high-end Bergdorf Goodman department store. Then Donald Trump denied it and thus “defamed” the alleged victim. Yesterday, in a civil suit brought in Manhattan the jury found that Donald Trump did not in fact rape Carroll, but had sexually abused and defamed her name and thus awarded her almost $5 million in damages. A strange decision and a strange case. Here's why.
The Timing
Carroll revealed her story about the department store incident in an article she wrote for New York Magazine in the Summer of 2019, the rape having allegedly occurred decades earlier in 1995 or 1996. She couldn't remember in which year.
Given the amount of time that had passed, the statute of limitations had long since expired. That is, until a very peculiar thing occurred.
Thanks to Kathy Hochul, the Governor of New York, a very unusual law was brought in the Empire State.
Last year, Hochul signed the Adult Survivor’s Act into law. Well temporarily. The change to New York’s code allows alleged victims of sexual offenses, such as sexual assault and unwanted sexual contact in the workplace, to file civil suits between November 24, 2022, and November 24, 2023 this year. You read that right. This transitory super law magically voids the statute of limitations for these crimes, but just for 12 months? Strange no?
Remember Governor Hochul is an avid Trump-hater, who detests all Republicans and prefer they leave “her state.”
Why did Carroll wait almost 30 years? And what is the quality of “justice” provided from a trial that would have been impossible to bring in 2021, and will be impossible top bring in 2024? Surely all victims matter. Or perhaps some matter more than others. Depending on who they target with their accusations?
The Victim
E. Jean Carroll is a strange figure by even Manhattan’s outré standards. Beyond her inability to even know the year if her alleged rape, and waiting decades to take any action at all, she has rather strange views about men in general, and young boys in particular, as well believing people think rape is “sexy.”
