Neely is not going to prison, as he is deceased.
Daniel Penny is the guy who strangled Jordan Neely to death for throwing a fit on the subway. Neely did not threaten anyone, he was just throwing a fit because he was obviously mentally ill.

The sad truth is that there is no adequate treatment for people like Neely who have mental problems.  Reagan threw them out of the institutions and onto the street, and they were at most given some pills and nowhere to live and no treatment for their illness.

Especially with a career criminal that had at least 40 arrests which includes assaulting the elderly and kidnapping a 7 year old girl.
