Thy have the right to an asylum hearing. Why? Because the UN Charter, that the US signed, agreed to provide asylum to those who it deems deserve it. This has nothing to do with Democrats or Republicans. It is simply what is required by treaty.
They have the right to APPLY for asylum in the US in the first "safe" country they enter after leaving their home country. FYI...that is Mexico if coming from further south.
Then there is this little item;
Effective May 11, 2023, the U.S. government will generally presume individuals who
unlawfully enter the United States through its southwest land border or adjacent coastal borders
are ineligible for asylum, unless they can demonstrate an exception to the rule or rebut the presumption.

The valid reasons for applying for asylum are:
Every year people come to the United States seeking protection because they have suffered persecution or fear that they will suffer persecution due to:
- Race
- Religion
- Nationality
- Membership in a particular social group
- Political opinion
Hopefully you noticed wanting a job is NOT a reason. Only about 39% of asylum request are approved.
