Trump will be prosecuted for Obstruction of justice relating to the deliberate theft of national defense information documents.

The circumstances of Trump an the documents are far more aggravated, enough to warrant an indictment. 

1. He told us on TV he has the right to take them.  (No, he doesn't.)
2. There is testimony that he instructed employees to move boxe of docs and hide them from the government, after a subpoena.  He conducted rehearsals of it. 
3.  A search warrant was issued for a search of his property, warrant signed by a federal magistrate, because he was refusing to cooperate.
4  There is mens rea and obstruction, both components of violating the Espionage act, and, as such, are the aggravated circumstances warranting indictment. 

The circumstances of Biden and Pence are inadvertent acquisition and full cooperation with the government in the return of the documents. Not enough
enough aggravated circumstances which warrant indictment (in fact, none, the mere holding of such docs, per DOJ policy of prosecutorial discretion, is not to prosecute for mere possession, alone, a courtesy extended to senators and members or the executive branch)
