Out of the many new details revealed in former President Donald Trump's third indictment, the most chilling one may be a discussion between Trump's White House deputy counsel Patrick Philbin and "Co-Conspirator 4" — who, based on the Jan. 6 Committee report, appears to be Jeffrey Clark, a former top Justice Department official in the Trump administration.

That discussion, in which the man believed to be Clark suggests using the Insurrection Act, underscores how Trump's inner circle wasn't simply seeking ways to delay Trump's departure from the White House, but actively gaming out how he could stay in power even in the face of a mass movement to restore democracy — using military force.

According to the indictment, Philbin repeatedly discouraged Trump and his loyalists from trying to stay in the White House beyond the end of his term. In December, he allegedly told Trump, “There is no world, there is no option in which you do not leave the White House [o]n January 20th.”

Then on the afternoon of Jan. 3, Philbin apparently tried to dissuade “Co-Conspirator 4” from trying to assume the role of acting attorney general as part of a reported bid to overturn the election results with Trump. He allegedly told that person that “there had not been outcome-determinative fraud in the election and that if the Defendant [Trump] remained in office nonetheless, there would be ‘riots in every major city in the United States.’”

The indictment alleges that Clark responded, “Well ... that’s why there’s an Insurrection Act.”

This stunning statement marks not just an authoritarian posture, but an authoritarian strategic vision. The Insurrection Act allows the president to deploy the military domestically to put down a rebellion or unrest.

The law has been invoked a handful of times in the past century, most recently by then-President George H.W. Bush to put down the Los Angeles riots in 1992 after the police beating of Rodney King.

Civil liberties experts have criticized the law for giving the president too much power:

The Brennan Center for Justice's Joseph Nunn has described it as "ripe for abuse," cautioning against the president's "almost limitless discretion to deploy federal troops in cases of civil unrest" under the law and Supreme Court rulings on presidential power.

In many ways the American public is at the mercy of the president to use the law in discerning and limited ways to deal with emergencies, not as a tool for quashing dissent.

It appears that the unnamed “Co-Conspirator #4” was inclined to exploit the law's extraordinary power as a way to quell massive resistance and consolidate power in the wake of a Trump coup.

What conservative media won’t tell you until trial is just how **** horrible Trump was, trying to stage a legal “soft coup” to cling to power and subvert the constitution.

What you’ll learn at trial is Trump assembled six nut jobs, outright bat **** crazy loonies, to steal the election.

They devised a scheme for Mike Pence to count bogus elector slates in SEVEN states.

Why the plotters included solid blue New Mexico is proof they knew, it was all a lie.  Nobody is crazy enough to believe Trump won New Mexico, where he lost by 11 points.

All of Trump’s family and every adult around Trump jumped ship and went on record they were no part of the attempted coup.

If Mike Pence had joined, there would have been troops in the streets to keep Trump in power, just like a banana republic.

There’s going to be a trial unless Trump’s family can beg him out of it.

At trial a bogus slate of Republican electors from New Mexico will be introduced into evidence the plotters were going to hand to Mike Pence to count instead of the real one.

There’s only one reason that fake document exists.

It was a plot steal a lost election.

Not even Fox News could spin how Trump really won a solid blue state, like New Mexico.

The trouble with telling lies, is just one little lie, that’s proven, proves all the others were lies.

 I was a Republican when I listened to the Watergate tapes.  I knew it was all over.  Nixon was a crook, trying to cover up a burglary.

Watching in real time someone lose their moral compass. Someone sacrificing their character at the altar of political ambition. Someone who knows better, who was there, who saw what happened on Jan. 6, who saw people running for their lives, who knows what Trump did was wrong and has said it wrong.

The thing that kills me about all this is that if Trump has evidence of widespread election fraud, which is what it will take to overcome this indictment, he still not has shown it anywhere.

If all these people — the Fox News opinion leaders, the GOP senators who went to Harvard and Yale like Ted Cruz and Josh Hawley — have evidence, then why haven't the American people seen it?

There is no evidence of fraud. None. What little they had, they tried and they lost. It went up in flames in dozens and dozens of courts across the country.

So this really is about whether the rule of law is going to survive. And if it wobbles, it will be for one reason: Republicans in this country who lost their love of country in order to further their political ambition.

Yes...I know that.  And my point is not "null and void".  An intelligent person, who is familiar with the US Constitution and the US criminal justice system, would understand the comments I quoted should either include the word "allegedly" or a disclosure of "in my opinion".  That is assuming you subscribe to innocent till proven guilty for everyone...not just demonrats.  It appears, based on his comments on multiple threads, that Bruce may not subscribe to that concept for everyone...thus my reminder.

There is also a faked up bogus slate of five Republican  electoral votes from solid blue New Mexico that no defense lawyer in America will be able to innocently explain when it comes into evidence at trial.

Trump should be remanded.

The judge won’t, but she should not give him the chance to run.

At the least they’ll revoke his passport.

Our man Trump needs to overturn Arizona, razor thin close, and Georgia, also very close, and then only one or two of three Rust Belt states, also where the results were close.

The results were close in Nevada, so that makes a little sense to include Nevada.

We have six closely fought ejections in six states.

Tell me why those fools included solid blue New Mexico their man lost by 11 points and was Democrat top to bottom in the legislature and state house?

It’s like intentionally leaving your DNA and fingerprints all over a gun you don’t need for a robbery.

A defense attorney doesn't need to explain it until the prosecution can show that Trump directly orchestrated it's creation.  Just suggesting the legislature do so isn't enough...especially if the legislature wasn't involved with picking that slate.

Do you really not understand the burden rest with the prosecution in every criminal case?  When I was in school, that was covered in basic civics.  I guess you haven't gotten that far in school yet.
