In a new article for The Atlantic, retired former federal judge J. Michael Luttig and top legal scholar Laurence Tribe make the case that the Constitution includes a provision that disqualifies Donald Trump from holding public office again.



Section Three of the Fourteenth Amendment is also known as the “disqualification clause.” It’s only two sentences long but it could doom Trump’s bid to return to the White House.



The disqualification clause “forbids the former president from holding the office of the presidency again because of his conduct in and around January 6, 2021,” says Judge Luttig. And as Tribe points out, it’s not a sanction against an individual. “The framers of the 14th Amendment took great care not to treat this as a punishment … Nobody has a right to be president without meeting the qualifications.”

Presidential Records Act (PRA) of 1978

You are helping to make the case for the extreme conservatives who want Trump barred from federal office.

The farthest right legal scholars don’t bend the constitution to elect Republicans.  They hate liberals and Democrats, but they do use a system.

First, they’ll read the law:

Section 3 Disqualification from Holding OfficeNo person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

What does that say, in plain English?

If you are an office holder that took an oath to support the Constitution—(President Trump)

Shall have engaged in insurrection or rebellion against the (Constitution) or given aid or comfort to the enemies of the same—-

Trump was indicted on four federal felony charges Tuesday that centered on his supposed attempts to discount legitimate votes in the 2020 presidential race and subvert the election itself. The indictment describes how Trump and his lawyers pressured Pence to overturn Joe Biden's victory by refusing to certify the results in the Senate on Jan. 6, 2021. Pence refused and had to be evacuated from the Senate chamber when members of the Jan. 6 mob called for him to be hung.

Then Trump can’t be President without 2/3 vote of Congress.

The conservative only looks at the text.

But, should you get to the intent of Congress right after the civil war they’d build a gallows for Trump.

The 14th amendment was written expressly to prevent a Trump from being in government again, passing out pardons and determining security clearances.

The 14th play was tried against several candidates for lower offices and every attempt was laughed out of court.  A primary issue, the FBI (who ran the investigation) does not refer the event as an insurrection.  Nobody has been charged with insurrection.  While not a requirement, those factors are considered.  There are also legal and constitutional scholars who (basically) say those supporting the theory are idiots.

By the way, Trump can be charged with, and convicted of, 15,000 felonies...that would not keep him from running for office and serving if elected.

Section 3 of the 14th Amendment does exist. It means something.  

Trump was a sworn office holder.  He was President.

The Yankees who wrote the 14th required defeated states to join in passing it because, the Yankees never considered the Civil War as an actual war, but a failed insurrection and rebellion.
 
It cost 300,000 dead United States soldiers four years to put that one down.

If you look at Congressional intent they intended never **** again.:)
