Trump Campaign Lawyer Admits to Judge: Our Search for Evidence of Fraud Produced Obvious Lies and ‘Spam’

A Trump campaign attorney conceded in court on Thursday morning that he tried to enter hundreds of dodgy form-filed affidavits into evidence, even though their own investigation found that a subset of the sworn statements that they received were filled with lies and “spam.”

“This is concerning,” Judge Daniel Kiley, from Arizona’s Maricopa County, remarked with some understatement.

“How is that a reliable process of gathering evidence?” the judge asked, later blocking admission of the so-called evidence.

Put on the spot by the judge was the Trump campaign’s lawyer Kory Langhofer, who explained the automated process that reflected their post-election evidence hunt.

It included an online form whose reliability Langhofer claimed was boosted by the fact that it included a CAPTCHA, which weeded out the bots.

The attorneys then visited the complainants’ homes. The Trump campaign said it excluded the submissions of those who swore to lies, but they included the ones they could not prove were lying into evidence.

Judge Kiley replied that this did not show the remaining affidavits are trustworthy.

“That just shows you cannot disprove what’s asserted,” Kiley noted.

Shortly after, Langhofer went sharply off-message with Trump representatives telling any media outlet that would listen about their vast voter-fraud conspiracy theory.

“This is not a fraud case,” Langhofer said, casting the lawsuit instead as allegations of flaws within the voting system. “It is not a stealing-the-election case.”

That marked the second time in as many days that attorneys for the Trump campaign disavowed in court what the president and his loyalists alleged in print, tweets and on the public airwaves.

On Wednesday, it was the campaign’s Porter Wright attorney Jonathan Goldstein who refused to allege fraud when pressed by a Pennsylvania judge.

“Your honor, accusing people of fraud is a pretty big step,” Goldstein said in Montgomery County Court of Common Pleas.


“And it is rare that I call somebody a liar, and I am not calling the Board of the DNC or anybody else involved in this a liar. Everybody is coming to this with good faith.”

Over in Arizona the next day, a Maricopa lawyer played on a Trump slogan to discredit the president’s conspiracy theories. What happened in Arizona was a success story, the attorney said: “Made Maricopa County Elections Great Again.”

The Trump campaign’s admission came toward the beginning of a daylong evidentiary hearing in a case that began as the so-called “Sharpiegate” lawsuit, the outlandish speculation that election workers handed markers to Trump voters to invalidate their votes on Election Day. The hearing is expected to last for five hours.

Due to technical errors with the court’s public access phone line, proceedings went into recess for a few hours before reconvening at 12:30 p.m. Mountain Time.

The judge attributed the problem’s with the system to an “external” influence, before witness testimony resumed with Maricopa County’s Director of Election Day and Emergency Voting Scott Jarrett.

Splashing more cold water on the “Sharpiegate” brouhaha, Jarrett explained that markers bleeding through a ballot did not lead to overvotes, the term for when a voter casts a ballot for more than the maximum allowable number of candidates.
Jarret testified that this happened in the 2020 election mostly with 19 candidates for judges, not presidential candidates, and Arizona Attorney General Mark Brnovich (R) found no evidence of voter disenfranchisement.

Jarrett testified that Arizona reported a grand total of 191 overvotes, far short of President-elect Joe Biden’s commanding 10,000-plus vote lead.

After an evidentiary shellacking on the issue, even Langhofer abandoned the Sharpie issue. He objected to cross-examination of witnesses about the issue on grounds of relevance, saying that issue would not figure during his closing arguments.

Judge Kiley overruled that objection: The questions were relevant because the witnesses spoke about the issue in their affidavits, and the Trump campaign detailed it in their lawsuit.

The Trump campaign’s parade of witnesses hardly bolstered their case.

When pressed by the Arizona Democratic Party’s counsel Daniel Arellano, each of the witnesses in turn conceded they did not know whether their vote was counted.

“Do you have any basis to believe your vote wasn’t counted?” Arellano asked voter Mia Barcello.

“Uh, I’m not sure,” Barcello replied with a laugh.

When pressed about it further, Barcello replied: “No.”

Ms. Barcello had plenty of company, with another witness responding “I couldn’t say” to the same inquiry and another replying “That’s correct” when asked if he did not know one way or another whether his vote was counted, a matter that could have been quickly settled by consulting the public record.

Not even the Trump campaign’s Arizona State elections day operations director Gina Swoboda believed otherwise—and admitted so under oath.

“I don’t know whether they were counted or not,” Swoboda said, adding that she could speak to voters’ “beliefs” but otherwise had “no way of knowing” whether or not that was true.

Testimony by the Trump campaign’s expert witness took a turn to the absurd when Zack Alcyone, whose business bio boasts of his experience in “ballot access calculations,” conceded that he is the business partner of Langhofer, the lawyer who argued the president’s case all day.

The website of the Phoenix-based software company Signafide lists them as co-founders.

Sarah Gonski, another lawyer for the Arizona Democratic Party, marveled at the changing theories advanced by the Republicans.

“Your honor, it’s not exactly clear what they’re asking for because it’s been a moving target,” Gonski noted, pointing theories about Sharpies, overvotes and a green button.

The voice of Maricopa County’s lawyer Thomas Liddy swelled with indignation as he reflected upon how Arizona Republicans’ claim of “Stop the steal!” whittled down to small-bore complaints about less than 200 ballots that ultimately got counted.

“Words matter,” Liddy noted.

“The ballots are as the ballots are, voted by the voters,” he said later, adding that changing the process at this late stage would amount to “overriding voters’ intent.”

Some six hours later, with passions riding high and an anxious nation awaiting a decision, Judge Kiley adjourned the proceedings and took the matter “under advisement.” He did not commit to a date to deliver a written ruling.

USPS ‘Whistleblower’ Told Agents Project Veritas Penned His Ballot-Tampering Claim

A postal worker whose allegation of ballot-tampering was at the center of Republican efforts to challenge the outcome of the presidential election has admitted to investigators that Project Veritas actually penned the affidavit laying out his claims.

A two-hour audio recording released by Project Veritas on Wednesday shows Richard Hopkins being interviewed by federal investigators over his claim, first publicized by Project Veritas, that he had overheard a postmaster instructing workers in Erie, Pennsylvania, to backdate mail-in votes to meet the Election Day deadline.

The audio had been touted by the conservative group as proof that Hopkins was manipulated by investigators but still stood by his allegations, despite House Democrats saying earlier this week that the U.S. Postal Service Office of Inspector General told them Hopkins admitted to fabricating the claims.

But instead, it captured him doing the very opposite, according to The Washington Post.

When he was asked if he wanted to stick with his claim about ballot-tampering, Hopkins said, “At this point? No.”

He said his allegation had stemmed from “assumptions” he made after overhearing tidbits of staffers’ conversations in the mail facility.

Hopkins told investigators not only that his affidavit was written by Project Veritas but that he wasn’t even entirely sure of what the group had included in it because he was in “so much shock I wasn’t paying that much attention to what they were telling me.”

A spokesman for Project Veritas acknowledged having a hand in the affidavit but insisted that the “affidavit was drafted with Mr. Hopkins’ input and requested revisions,” according to the Post.

More than 130 Secret Service officers are said to be infected with coronavirus or quarantining in wake of Trump’s campaign travel

More than 130 Secret Service officers who help protect the White House and the president when he travels have recently been ordered to isolate or quarantine because they tested positive for the coronavirus or had close contact with infected co-workers, according to three people familiar with agency staffing.

The spread of the coronavirus — which has sidelined roughly 10 percent of the agency’s core security team — is believed to be partly linked to a series of campaign rallies that President Trump held in the weeks before the Nov. 3 election, according to the people, who, like others interviewed for this report, spoke on the condition of anonymity to describe the situation.

The outbreak comes as coronavirus cases have been rapidly rising across the nation, with more than 152,000 new cases reported Thursday.

The virus is having a dramatic impact on the Secret Service’s presidential security unit at the same time that growing numbers of prominent Trump campaign allies and White House officials have fallen ill in the wake of campaign events, where many attendees did not wear masks.

Among those who are infected are White House Chief of Staff Mark Meadows and outside political advisers Corey Lewandowski and David Bossie.

In addition, at least eight staffers at the Republican National Committee, including Chief of Staff Richard Walters, have the virus, according to officials at the organization.

Some of those infected are in field offices across the country, including Pennsylvania, where some believe they were exposed in large staff gatherings, an official said.

White House spokesman Judd Deere said the administration takes “every case seriously.”

He referred questions about the Secret Service outbreak to agency officials.
A spokeswoman for the Secret Service declined to comment.

Trump went on a travel blitz in the final stretch of the campaign, making five campaign stops on each of the last two days.

On Nov. 2, Trump’s campaign schedule required five separate groups of Secret Service officers — each numbering 20 to several dozen — to travel to Fayetteville, N.C.; Scranton, Pa.; Traverse City, Mich.; and Kenosha and Grand Rapids, Wis.; to screen spectators and secure the perimeter around the president’s events.

President-elect Joe Biden made two campaign stops that day that also required Secret Service protection, but in smaller numbers.

The agency is also examining whether some portion of the current infections are not travel-related, one government official said, but instead trace back to the site where many Secret Service officers report for duty each day: the White House.

White House staff largely eschew wearing masks, despite public health guidelines that they help contain the spread of the virus, and some Secret Service officers on duty at the complex have also been seen without them.

The Secret Service employs roughly 1,300 officers in its Uniformed Division to guard the White House and the vice president’s residence.

The officers are also the backbone of security for presidential trips out of town and other official events.

Earlier this week, agency supervisors told other staff about the large number of officers who have contracted the virus and said there has been expanded testing to help limit the spread, according to the people familiar with the situation.

The number of officers who have been pulled off duty creates a major stress on an already overworked team and will force many officers to forgo days off and work longer hours to compensate for absent co-workers.

A 2015 blue-ribbon panel identified overworked Secret Service officers as one key factor that contributed to security breaches at the White House.

“Being down more than 100 officers is very problematic,” said one former senior Secret Service supervisor. “That does not bode well for White House security.”

It’s not the first time the Secret Service has been hit hard by the decisions of Trump and Vice President Pence to travel during the pandemic.

This summer, dozens of Secret Service agents fell ill or were sidelined and forced to quarantine in the wake of the president’s massive indoor stadium rally in Tulsa in June and the vice president’s subsequent trip to Arizona.

At the time, Secret Service spokesman Catherine Milhoan said in a statement to The Washington Post that the agency “continues to methodically assess the unique requirements necessary to operate in the ongoing pandemic environment.”

But many of Trump’s own choices put his protection team at heightened risk, specifically his choice to travel out of state and hold large public events.

Secret Service agents and medical professionals were shocked early last month when Trump — then being treated at Walter Reed National Military Medical Center for the coronavirus — insisted on taking a ride outside the hospital to wave to supporters from inside a government sport-utility vehicle.

He wore a cloth mask, but many feared he was unnecessarily endangering the Secret Service agents inside the vehicle.

Deere defended the outing at the time, telling reporters “appropriate precautions were taken in the execution of this movement to protect the president and all those supporting it.”

He said precautions included personal protective equipment, without elaborating, and said the trip “was cleared by the medical team as safe to do.”

While many people in Trump’s orbit have contracted the virus this year, the most recent outbreak at the White House has been particularly extensive.

Many of those who are now sick attended a campaign party last week in the East Room, or were exposed to someone who did.

Meadows was among those in the East Room of the White House when Trump gave remarks around 3 a.m. Wednesday to a crowd of about 150 of his top aides, donors and allies, as well as family members.

During that event, Meadows worked the room extensively, without a mask, speaking to dozens.

More than a dozen White House aides have tested positive for the virus in the past week, including a range of low-level assistants and secretaries, officials said. Offices that have been affected include political affairs, legislative affairs and communications.

Meadows’s positive diagnosis was revealed last week, along with the fact that he had urged staffers not to disclose it.

The chief of staff is not expected to return to the office until next week, a person close to him said.

People present at Wednesday night’s campaign party in the East Room who were around Meadows, Lewandowski and other now-sick staffers say they have not been contacted by the White House.

Several staffers said they were nervous about going to work because there has been such an outbreak.

“I’m trying to work from home,” one senior administration official said Wednesday afternoon. “It’s not really safe to be in there right now.”

Several aides said they were frustrated by a lack of transparency from their superiors, particularly Meadows, and that they did not notify more people of diagnoses.

The signers were from 15 different federal court districts including: Pennsylvania, North Carolina, New Mexico, Maryland, Ohio, Kentucky, Iowa, Arkansas, south and northeaster New York, Kansas, California, the Virgin Islands and the Northern Mariana Islands. Two were from Oregon.
