So where is the TRIAL in the COURTS that made that determination??? And where are the CHARGES OF INSURRECTION that he could/would be tried for???

YOU HAVE NEITHER for the SCOTUS TO DECIDE, which is EXACTLY what they are going to state- YOU CAN'T BE UNILATERALLY DECLARED GUILTY OF A CRIME YOU HAVE NEVER BEEN CONVICTED OF, ****!!! And that is PRECISELY what has happened. IN THIS NATION, you are INNOCENT until proven beyond any reasonable doubt that you committed a crime. Trump hasn't been convicted on ANY "insurrection" crime, NOR has be even been charged with as much!!

Nothing in the 14th amendment says you need to be charged for a crime. 

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

He told them they have to fight like hell or they wouldn't have a country. He assembled and sent them.on their way for insurrection. And didn't call the insurrection off even though Republicans were begging him to tell them to stop the insurrection.

SO?? WE as a people, have a CONSTITUTIONAL RIGHT of ASSEMBLY and even for assembly AGAINST government actions. THAT is not an insurrection. 

And since there is a LAW regarding insurrection, you MUST be convicted of it since the 14th Amendment ALSO gave Congress that authority to pass such a law. See US Code. 18 U.S. Code § 2383 - Rebellion or insurrection

And you could make a case that Mike Johnson blurring the faces on the jan.6th tapes so they don't get prosecuted by the government is aiding the insurrectionist.
