According to section 3 of the Fourteenth amendment:

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability. 

Does this give justification for Trump to not be on the Colorado primary ballot? The problem of course is that we really don't know what happened on January 6th and the amendment mainly applies to Confederates after the Civil War when it was written in 1868.

There are two primary things that need to be decided. I have heard and/or read these over the last year...do NOT remember where or who so if you're live R Suave, feel free to ignore.

- Since Congress has codified insurrection as a crime into the US Code, does there need to be a conviction in a court of law to determine if (1) an insurrection occurred and (2) if the person participated. Remember, no organization with criminal investigative authority has investigated the events of J6 and said it was an insurrection.

- Is the President an "officer of the United States"? There is an logical justification that he is not.

To a lesser degree, there also needs to be a determination on who has the authority to enforce this section.

It's an attempt to overthrow an existing government by brute force..
