That is what the Justice Department and Special Counsel are really saying. 
It would suggest that the Dem's have considered other options and are starting to change courses ...

On November 1, 2017, Hur was nominated by President Donald Trump to be the next United States Attorney for the District of Maryland.

Hur has made donations to the campaigns of a number of Republican political candidates.

Thats a valid point and yet not entirely true.

NeoConism has devoured both sides of the aisle.
But yes, many like Cheney fled to Biden and the Dems.

The question is why he was putting those comments in a legal statement.  He isn't a doctor, and is unqualified to make a diagnosis regarding Biden. It was inappropriate.

A proper legal statement only contains factual information; it doesn't contain Hur's personal beliefs regarding Biden.

The problem with Trump was that he wouldn't have been prosecuted if he had just handed them over.  Outgoing presidents, and vice presidents usually don't do their own packing.  That is even true for Trump. 

The National Archives told Trump that there were missing documents, and to hand them over.  He refused, and told them that the classified documents were party favors that he gets to keep and show off to his friends.  All he had to do was hand them over, and none of this would have happened.

The Biden situation was a little different.  When cleaning out a closet, aides found a small number of documents.  Biden immediately informed the National Archives, had them take possession of the documents, and cooperated fully with the investigation.

It is interesting that no charges were brought against Mike Pence (and the documents were in his house), and no questions were asked regarding his mental acuity.

The same thing happened with Mike Pence, with the same end result:

The Justice Department's national security division, which looked into the discovery of classified documents at the former vice president's Indiana home, informed his attorney that no charges will be filed.

Then what was the reason that Mike Pence was neither investigated or prosecuted.  Pence was an outgoing vice-president caught with classified documents in his home.
