No...SCOTUS simply invented the reason. Section 3 wasn't clear on the issue.

It was a 9-0 descision that CO did not have the authority to enforce...meaning the liberals justices felt the same way. Damn...you are one stupid **** liberal.

The three liberals DID NOT think CO had the jurisdiction/authority..."The majority announces that a disqualification for insurrection can occur only when Congress enacts a particular kind of legislation pursuant to Section 5 of the Fourteenth Amendment," Kagan, Sotomayor and Jackson wrote. "In doing so, the majority shuts the door on other potential means of federal enforcement.
Aside from Congress, it would take a federal court to decide the matter. Meaning a state would have to petition the court or a candidate would need to be convicted. The Judiciary Branch is the only other federal branch that could have authority.
BTW...Section 5 of the Amendment: "The Congress shall have power to enforce, by appropriate legislation, the provisions of this article."
