The proposed new pathways are intended to address the racial disparities in bar exam pass rates

Task force member Jordan Couch cited a 2021 American Bar Association study that found white law graduates were almost 40% more likely to pass the bar exam than Black law graduates. Bar exam critics have long pointed to that gap as evidence the licensing exam is biased against minority test takers, while the National Conference of Bar Examiners has said it's the result of myriad factors including educational disparities.
