Ohio’s secretary of state on Friday signaled that the Democratic National Convention may take place too late for President Joe Biden to appear on the general election ballot in the state, according to a letter obtained by NBC News.

 “The Democratic National Convention is scheduled to convene on August 19, 2024, which occurs more than a week after the August 7 deadline to certify a presidential candidate to the office,” Secretary of State Frank LaRose wrote to Ohio Democratic Party Chairwoman Liz Walters.

 ABC News first reported about the existence and content of this letter.

 In the note, LaRose goes on to say that the oversight can be rectified in two ways: either by the Democratic Party moving up its nominating convention or by getting the Ohio state legislature to “create an exemption to this statutory requirement” by May 9 in accordance with state law.Ohio state Rep. Allison Russo, the state House minority leader, and state Sen. Nickie Antonio, the state Senate minority leader, were also copied on LaRose’s letter.
 

Is he a democrat or a republican?

This happened in 2020 with both the republucan and democrat and the state party let both be on the ballot.

The PARTY doesn't decide, ****, but the LEGISLATURE needs to pass a LAW permitting it. The PARTY doesn't make laws, their LEGISLATURE DOES!! And that LAW is going to be ENFORCED!! Sucks for you, huh?? I mean isn't that what you have been DEMANDING for 4 years now???

No, ****, it will take the OHIO LEGISLATURE to pass a WAIVER or to change the deadline to 60 days before the election. And UNLESS they do that, the Democrat ASSWIPES are just **** OUT OF LUCK!! They should pay better attention to the LAWS OF THE STATES instead of being the POMPUS ELITIST ASSES ALL OF YOU ARE, ****!!!

COLUMBUS, Ohio — Barack Obama, Mitt Romney, Donald Trump and Joe Biden all have appeared on Ohio’s November ballots despite their parties nominating them after an obscure deadline in state law.But that same deadline could prevent President Joe Biden from qualifying for Ohio’s November ballot this year — a development that might have wide-reaching and even national ramifications for U.S. Sen. Sherrod Brown and other Ohio Democrats — unless a court or Republican lawmakers agree to intervene, a top lawyer for Republican Secretary of State Frank LaRose has warned.

A similar situation occurred before the 2020 presidential election, too. Both the Republican and Democratic conventions were scheduled outside the deadline window, so Ohio lawmakers approved changing the cutoff to 60 days — but only for that election.
