Supreme Court limits obstruction charges against January 6 rioters

• Today’s ruling: The Supreme Court has ruled that the Justice Department overstepped by bringing obstruction charges against hundreds of people who rioted at the US Capitol on January 6, 2021, prompting at least some of those cases to be reopened. • Possible implications for Trump: The high court ruled that the charge could still be filed against the rioters if prosecutors are able to demonstrate they were attempting not just to push their way into the building, but rather stop the process to certify the results of the election. A federal judge paused some filing deadlines in the classified documents case against former President Donald Trump in a brief order Saturday, and agreed to additional briefings on whether she should pause the case to consider what effect the Supreme Court’s immunity ruling may have on the criminal proceedings in Florida.

Judge Aileen Cannon set a two-week briefing schedule for those arguments and paused three unrelated filing deadlines that were scheduled to take place during that period.

In a statement after the judge’s order, a spokesperson for Trump said, “Cannon has rightfully issued a stay and called for additional briefing on the application of the Supreme Court’s historic decision on Presidential Immunity” and called for the case to be “thrown out entirely.”

Prosecutors dropping some Jan. 6 obstruction charges after Supreme Court ruling 



Federal prosecutors have moved to drop charges for some Jan. 6 rioters accused of attempting to obstruct the certification of the 2020 election results following a Supreme Court rulingnarrowing how the government can use the count. 

Since the justices ruled 6-3 that the government overreached in its sweeping prosecution of the Capitol attack, the Justice Department has scrambled to redefine its use of the affected charge: obstruction of an official proceeding.

But in some instances, dropping the charge altogether has proved more efficient, according to court filings.
