Why? His presumption that TRUMP is somehow under the laws of UCMJ are completely false. And his opinion would be even more so. 
Presumption is a rule that allows a court to assume a fact is true unless there is evidence to prove otherwise1. It is different from an opinion, which is a belief or judgment based on limited information
