Being he was in the military; he should have understood that he could have just complied with the orders being given by the cops. Instead, he played games and got arrested. Not the best decision making.
He resisted arrest. Innocent people don't usually resist arrest and had he not resisted he would probably have been released very quickly. Resisting alone allows them to hold someone.

Let's just wait for ALL the evidence to come out. ICE agents are required to wear Body Cams.
