struck down on September 10, 2025, by the First District Court of Appeal, marking a major shift in the state’s gun laws.

The court ruled that Florida’s longstanding ban on openly carrying firearms is unconstitutional, citing the Second Amendment and a 2022 U.S. Supreme Court decision that emphasized the “historical tradition” of firearm regulation

The case was brought by Stanley Victor Mcdaniels, who was arrested in 2022 while openly carrying a handgun during a political demonstration in Pensacola

Judge Stephanie Ray wrote: “No historical tradition supports Florida’s Open Carry Ban… history confirms that the right to bear arms in public necessarily includes the right to do so openly.”

The ruling applies to North Florida for now, but it opens the door for broader challenges statewide

Governor Ron DeSantis praised the decision, saying it aligns with his long-held position and the majority of states across the U.S.

Attorney General James Uthmeier also supported the ruling, calling it a “big win for the Second Amendment rights of Floridians”

When it applies to the whole state I think Florida will become the 47th open carry state.  With odds like that antigun nutter will have a difficult time getting "gun control" legislation passed.

They are one of those odd states where the have permiless concealed Carr but no permit less open carry.
