Evidence is subject to counter evidence. Evidence can be overcome.

I knew someone whose house was burgled. Another person, for nefarious reasons, manufactured evidence that I was the burglar. When confronted with the evidence against me, I was easily able to prove the evidence false - but I did not.

Instead, I offered an ethical-standing argument: Myself. I looked my friend in the eye, acknowledged that the evidence was damning, and gave him my word I had not done the crime. He immediately apologized for even having confronted me with the evidence - whereupon I provided the fulsome proofs of my innocence, which included an iron-clad alibi.

If you prove I did a thing, my evidence has been overcome.

"I have evidence" and "I have proof" will always be different pronouncements, IMO. :)
