The law about classified information doesn't say one thing about "intent," but Comey by himself let Hillary off on that non existent standard.
Anyone else would have been indicted.

FBI Director James Comey testified that the FBI took the investigation into Hillary Clinton's team, over their email security, very seriously. The main problem keeping the FBI from indicting Clinton seems to be that they couldn't prove intent. The bureau, however, proved that Clinton's team did not follow classified information security procedures.
Sen. John Kennedy (R-LA) tried to examine other crimes in which intent was not necessary to prove guilt, like torture.
