They tried that in the case of former WH Counsel Don McGahn.
He was subpoenaed last March, and even though a federal court ordered him to comply with the subpoena, Trump is still fighting it.
He is appealing because he hopes to drag it out until after the election.
Trump has abused the appeals process for decades even as a private citizen.
Companies that he did business with would sue him for failing to pay what they agreed upon, and he would drag it out in court so long that they would eventually drop the case because they could no longer afford the legal fees.
He drove many small businesses out of business.
