Kennedy then pressed Lutnick on a legal principle that holds the executive branch should defer to Congress when it comes to enacting major policy changes, known as “the major questions doctrine.” 

It could be a deciding factor in multiple lawsuits challenging the Trump administration’s ability to unilaterally impose tariffs, a power the Constitution grants to Congress. The issue is likely to be decided by the Supreme Court. 

Lutnick said he was unfamiliar with the principle. 

Kennedy said in an interview outside the hearing that he was disturbed by that response. “I mean, he just lost in court, and it’s a central part of the decision,” Kennedy said. “And it’s really going to impact trade policy.”
