This is from Bill Barr's 19 page unsolicited memo to the DOJ before he was appointed AG, in which without knowing anything about the investigation, he called Mueller's obstruction theory 'fatally misconceived.'
IOW, Barr is saying that Mueller should not have even been allowed to 'interrogate' the president about obstruction until he first established an underlying crime.
(I find it interesting that he used the word 'interrogate' and not question.
IMO that seems like he's biased.)
Guess he never heard of Martha Stewart or Scooter Libby.
Both were convicted of obstruction without being charged with any underlying crime.
Stewart was convicted of four counts of obstructing justice and lying to investigators.
Libby was convicted of four counts of perjury, obstruction of justice, and making false statements.
